Discord Says It Will ‘Evaluate’ GTA 6 Leak Subpoena Amid Privacy Fears

Discord Says It Will ‘Evaluate’ GTA 6 Leak Subpoena Amid Privacy Fears

On August 20, Rockstar Games’ parent company, Take-Two, filed petitions for subpoenas of records from Microsoft and Discord related to the recent spread of Grand Theft Auto 6 leaks. A federal court granted the requests a day later, but some users have been worried about how broad the data requests appeared to be. Discord now says that it hasn’t yet been served with any subpoena from Take-Two, and will “evaluate” any subpoena it does receive before responding.

“I can share an update on this: Discord has not yet been served with a subpoena from Take Two,” the company’s marketing director, Ryan Rigney, wrote on X on August 24. “When we do, we’ll evaluate the validity and scope before responding.” It was in response to a post that went viral on the platform spreading concerns that Take-Two was going after data for users far beyond anyone who might seemingly be associated with the source of the original data breach. It’s also unclear if Take-Two is following up on strong, actionable leads, or just grasping for any clues it can as fresh GTA 6 leaks flood the internet.

The subpoena requests “registration and last-login IP addresses, phone number, linked connections (Google/Xbox/etc.)” and related data for seemingly thousands of users spread across the discord.gg/odyssey and discord.gg/darkviperau servers. The petition filed in court included a potential September 4 deadline for Microsoft and Discord to respond with the information. The former has already signaled its willingness to help.

“We are working closely with Take-Two and Rockstar Games to support efforts to protect creative works and intellectual property,” Xbox CTO Scott Van Vliet wrote on X last week. GTA 6 will be one of the biggest releases ever on Xbox Series X/S, and as a console partner, Microsoft has a vested interest in maintaining a strong partnership with Take-Two and its subsidiaries. Discord, on the other hand, is a communications platform that is ostensibly supposed to keep its members’ data private and out of other people’s hands.

Discord’s popularity with players has made it a go-to place for sharing leaks, and as a result, it’s a frequent target of subpoena requests from angry video game companies. The company has occasionally pushed back on requests it considers overly broad. “Discord is committed to fulfilling its obligations under the law, but acting as your copyright assertion partner is not one of them,” one of the company’s lawyers wrote to publisher Nexon in a July 2024 legal fight.

But the company has also banned servers, like those for Switch emulators, that have been accused of aiding video game piracy or become embroiled in court injunctions. “But from time to time, we do get DMCA requests,” Discord co-founder Jason Citron told The Verge in 2024. “Or sometimes we get court orders and we have to interact with law enforcement. So we do have a process in place to respond to those things effectively. We do have a process for those things.”
